Procedure for termination and restoration of power supply to the facilities of legal entities consumers

In accordance with sub-clause 2 of clause 7.5 of the "Retail Electricity Market Rules", approved by the Resolution of the National Energy and Utilities Regulatory Commission No. 312 dated 14.03.2018 (hereinafter - REMR), and sub-clauses 11.5.2 and 11.5.12 of Chapter XI of the Distribution System Code (hereinafter - DSC), approved by NEURC resolution No. 310 dated 14.03.2018, in case of failure to comply with the terms of concluded electricity supply agreements regarding timely and full payments for consumed electricity, the electricity supplier has the right to apply to the distribution system operator (hereinafter - DSO) to terminate the power supply to the User (consumer) and, after notifying the debtor consumer, carry out appropriate measures to terminate the power supply to their facilities.

Sub-clause 2 of clause 7.5 of the REMR provides that full or partial termination of electricity supply to the consumer is carried out:

by the electricity supplier, provided the consumer is notified no later than

10 working days before the disconnection date in case of:

- arrears in payment for consumed electricity in accordance with the terms of the agreement with the electricity supplier;

- denial of access for authorized representatives of the electricity supplier to the commercial metering devices located on the consumer's premises.

The date of receipt of such warnings shall be considered the date of their personal delivery, confirmed by the recipient's signature and/or registration of incoming correspondence, or the third calendar day from the date of receipt by the post office serving the recipient (if sent by registered mail).

The warning of electricity supply termination may be provided to the consumer in another way stipulated by the agreement with the electricity supplier and the agreement with the system operator or its annexes.

Procedure for termination of power supply to consumers

In case of non-fulfillment (violation) by the consumer of the terms of the electricity supply agreement (hereinafter - the Agreement) regarding timely and full payments for consumed electricity, as well as payment terms regarding prepayment and advance payments, the consumer is served with a warning of power supply termination, and in the case of non-fulfillment (violation) by a consumer-legal entity of the terms of the electricity supply agreement (hereinafter - the Agreement) regarding timely and full payments for consumed electricity, as well as payment terms regarding prepayment and advance payments

After the expiration of the debt repayment period specified in the warning, the Supplier sends the DSO a "Request from the Electricity Supplier to the DSO to terminate power supply (electricity supply) to consumers," based on which the DSO terminates the power supply to the consumer within 10 working days from the date of receipt of the Request and provides the Supplier with relevant written information indicating the actual date of termination and the costs incurred (to issue an invoice for cost reimbursement to the debtor consumer).

Procedure for restoring the consumer's power supply due to the elimination of violations that led to the termination (restriction) of power supply.

In the event of a consumer's application to the Supplier for restoration of power supply, provided that:

- the violation is mandatory eliminated by the consumer (payment of the debt incurred according to the terms of the Agreement after disconnection);

- the consumer pays invoices for the reimbursement to the Electricity Supplier of the DSO costs related to the termination and restoration of power supply to consumers;

The Supplier sends to the DSO the "Electricity Supplier's Application to the DSO for Restoration of Power Supply to Consumers."

The DSO restores the power supply within 5 working days in rural areas or 3 working days in cities from the date of receipt of the "Application for Restoration of Power Supply to Consumers on the grounds of elimination of violations that led to the termination (restriction) of power supply."

The costs of the system operator for performing works to terminate and restore the power supply to the consumer's electrical installation (reconnection of the electrical installation) are covered at the expense of the initiator of these works, which are reimbursed to them by the consumer, if the termination of the supply (distribution or transmission) of electricity to the consumer was carried out in accordance with the procedure established by these Rules.
