Rights of the electricity consumer
According to the Retail Electricity Market Rules approved by the NEURC Resolution dated 14.03.2018 No. 312 (hereinafter - REMR), the electricity consumer has the right:
1) to connect their own electrical installations to the networks of the system operator or another owner of electrical networks in the manner provided by the Distribution System Code or the Transmission System Code;
2) to choose an electricity supplier;
3) to choose commercial offers with different tariff plans;
4) to simultaneously have more than one concluded electricity supply agreement, subject to compliance with the REMR and the Commercial Metering Code. In this case, the electricity supply agreement is concluded between the supplier and the consumer and provides for the supply of the entire volume of actual electricity consumption by the consumer in a certain period of time by one supplier;
5) to purchase electricity for their own consumption under bilateral agreements according to the Market Rules and in organized market segments, provided they conclude an imbalance settlement agreement and an electricity transmission services agreement with the transmission system operator, and in the case of connection to the distribution system — additionally a distribution services agreement with the distribution system operator; or to purchase electricity on the retail market from electricity suppliers or producers who generate electricity at distributed generation facilities, in accordance with the REMR;
6) to receive quality services for distribution (transmission), supply, and commercial metering of electricity;
7) to change the electricity supplier under the conditions defined by the Law of Ukraine "On the Electricity Market" and the REMR;
8) to receive electricity of proper quality in accordance with the terms of the agreement and electricity quality standards;
9) to receive information regarding electricity quality, tariffs (prices), payment procedures, and the conditions and modes of its distribution and consumption;
10) to receive compensation applied in case of non-compliance with electricity supply service quality indicators;
11) to compensation for damages in accordance with the terms of the agreement and the legislation of Ukraine, applied in case of non-compliance with electricity supply service quality and electricity quality indicators;
12) to apply to the electricity supplier regarding changes to the contractual terms in the manner provided by the REMR;
13) to access the settlement metering devices installed outside the consumer's facility and information stored in the primary database of electronic multifunctional settlement metering devices;
14) to receive compensation from the system operator within the limits of reasonable costs for the maintenance of technological electrical networks that are jointly used by the system operator and the consumer;
15) to receive from the relevant electricity supplier information provided for by the legislation and the terms of the electricity supply agreement;
16) to receive from the relevant electricity supplier notifications of its intentions to amend any terms of the electricity supply agreement no later than 20 days before making these changes and, in case of disagreement with the proposed changes, to terminate the agreement without paying any penalties provided for by the agreement for its early termination;
17) to transfer the functions of operating their electrical installations on the basis of a separate agreement to another organization that has the right to carry out such activities;
18) to receive from the distribution system operator, which distributes electricity to a sub-consumer, a refund for the distribution of electricity not metered by the sub-consumer's metering devices, and from the sub-consumer — the cost of this electricity;
19) to access information regarding activities in the electricity market in the manner and volume determined by the Market Rules and other regulatory acts governing the functioning of the electricity market;
20) to compensation for damages caused by the actions or inaction of a sub-consumer, electricity supplier, network owner, small distribution system operator, system operator, or commercial metering service provider.
- Non-household consumer, in addition to the above rights, has the right to organize additional metering sites at the same address in accordance with design solutions agreed with the relevant system operator. In this case, the design must exclude the possibility of connecting electrical installations or current receivers not provided for by the project to the electrical networks at additional (separate) metering sites.
Household consumers and small non-household consumers have the right to receive universal services in accordance with the Law of Ukraine "On the Electricity Market".
