Procedure for Concluding Contracts Between Industrial Consumers

In accordance with the Laws of Ukraine "On the Electricity Market" and "On the National Commission for State Regulation in the Spheres of Energy and Utilities", the Rules of the Retail Electricity Market were approved by the NEURC Resolution No. 312 dated March 14, 2018, which regulate the contractual relations between suppliers and consumers.

After the entry into force of regulatory acts implementing the requirements of the Law of Ukraine "On the Electricity Market", the settlement of contractual relations in the retail electricity market is carried out by consumers acceding to a public electricity supply contract through the submission of relevant applications for accession.

The consumer contract and the contract for the supply of electricity to the consumer are public contracts and are concluded taking into account Articles 633, 634, 641, 642 of the Civil Code of Ukraine according to the contract form provided for by the Rules of the Retail Electricity Market.

To accede to the Electricity Supply Contract, you may choose one of the following methods:

List of Documents Required for Accession to the Electricity Supply Contract:

an extract from the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Formations (hereinafter - USR), printed from the Internet, or a copy of the certificate, or a copy of the extract from the USR;

a copy of the document determining the right of ownership or use of the facility (premises), or a copy of the document confirming the right of ownership or use of the land plot or its part (in the absence of a facility on the relevant land plot), the right to place electrical installations on the territory of economic activity for the distribution of electric energy (in the absence of the Consumer's facility)*;

a copy of the declaration (notification) on the commencement of construction works or a permit for construction works (for concluding an electricity supply contract for construction sites)*;

a copy of the declaration of readiness of the facility for operation or a certificate (for newly built and reconstructed electrical installations)*;

a copy of the document confirming the authority of the person to conclude the contract (extract from the constituent document on the authority of the head (for legal entities), a copy of a power of attorney issued in the prescribed manner, etc.), if necessary;

a copy of the data sheet (passport) of the distribution point(s) of the Consumer's facility*;

information on the expected volumes of electricity consumption*.

Note: In case of concluding an electricity supply contract for a consumer with two or more of the Consumer's facilities, documents marked with "*" are submitted for each of the Consumer's facilities.
