State Institutions in the Electricity Sector
A permanent independent state collegial body whose purpose is state regulation, monitoring, and control over the activities of business entities in the fields of energy and communal services is the National Energy and Utilities Regulatory Commission (NEURC/Regulator).
The central executive body that ensures the formation and implementation of state policy in the electricity, nuclear-industrial, coal-industrial, peat-extracting, oil and gas, and oil and gas refining complexes (fuel and energy complex), as well as ensures the formation of state policy in the field of supervision (control) in the power engineering and heat supply sectors, is the Ministry of Energy of Ukraine (Minenergo). The activities of Minenergo are directed and coordinated by the Cabinet of Ministers of Ukraine.
The central executive body whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Energy and Coal Industry and which implements state policy in the field of supervision (control) in the power engineering and heat supply sectors is the State Energy Supervision Inspectorate of Ukraine (State Energy Supervision).

The central executive body, whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine through the Vice Prime Minister of Ukraine - Minister of Regional Development, Construction, and Housing and Communal Services, and which implements state policy in the field of effective use of fuel and energy resources, energy efficiency, renewable energy sources, and alternative types of fuel, is the State Agency on Energy Efficiency and Energy Saving of Ukraine (SAEE).
The central executive body, whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine and which implements state regulatory policy and policy in the field of supervision (control) in the field of economic activity, is a specially authorized body on licensing and permit systems in the field of economic activity and coordinates actions on simplifying the regulatory framework and deregulation of economic activity, is the State Regulatory Service of Ukraine (SRS/Regulatory Service)
The state body with a special status, whose purpose is to provide state protection of competition in entrepreneurial activity and in the field of public procurement, is the Antimonopoly Committee of Ukraine (AMCU). The features of the special status of the AMCU are determined by its tasks and powers, including its role in the formation of competition policy.
The central executive body, whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine, is the Ministry of Economic Development and Trade of Ukraine (Ministry of Economic Development). The Ministry of Economic Development is the main body in the system of central executive bodies that ensures: the formation of state policy in the field of consumer protection, state policy on price control, state regulatory policy, and state policy on licensing, permit systems, supervision (control) in the field of economic activity; forms and implements state policy of economic, social development, and trade, state industrial policy, state policy in the field of technical regulation, standardization, metrology, and metrological activity, etc.
The central executive body ensuring the formation and implementation of state regional policy, state housing policy, and policy in the field of construction, architecture, urban planning, housing and communal services, as well as ensuring the formation of state policy in the field of architectural and construction control and supervision, control in the field of housing and communal services, in the field of efficient use of fuel and energy resources, energy saving, renewable energy sources, and alternative types of fuel, is the Ministry of Communities and Territories Development of Ukraine.
Energy Ombudsman.
Clause 5 of Section IV of the Law of Ukraine "On the National Energy and Utilities Regulatory Commission" provides for the introduction of the institute of the energy ombudsman. Pursuant to Clause 5 of Article 76 of the Law of Ukraine "On the Electricity Market," the consideration of complaints from household and small non-household consumers regarding the actions or omissions of electricity suppliers and distribution system operators, and the resolution of disputes between them, are also carried out by the energy ombudsman. The legal status, procedure, and conditions for the activities of the energy ombudsman are determined by law. Relevant provisions are also defined by clause 1.2.16 of Chapter 1.2 of Section I of the Retail Electricity Market Rules, approved by NEURC Resolution No. 312 dated March 14, 2018 (as amended).
The Verkhovna Rada of Ukraine has registered the Draft Law on the Energy Ombudsman dated September 4, 2017, No. 7059. This draft law has been submitted for consideration to the Committee on Fuel and Energy Complex (main) and 12 other committees. There are no results of the consideration yet.
